You have to be a special kind of stupid to sue the institution were you are on scholarship and a special kind of dumb attorney to sue where there is not basis.
Judge: So what grounds are you filing suit on?
Attorney: well we don’t like the rules and the restrictions
Judge: Don’t let the door hit you in the ass on way out
 
A test case will occur. I think it might be more along the lines of someone who blurred the edges, by accepting something very trivial. If sanctions fell on that player, I can see an attorney who wants the publicity challenging it based on factors related to the player's individual rights. After all, this whole thing is being created to give them compensation for name and likeness usage. Kind of hard to keep that in a bottle, if a kid gets free juice at a juice bar, so they can put a picture of him up, taking a swig.

If I was a judge, I would not throw a case like that out. It borders too much on individual rights, like it or not.

But, that's just my opinion, and everyone is entitled to their own, but we won't know for sure, until something does pop up to test the ruling. What I find as a challenge is that it is going to be unevenly applied across states, based on laws enacted, or not enacted, and that in itself is going to create tests. A kid in Alabama should not be allowed to get more money than a kid in Minnesota. Therein lies the challenge, and the grey areas.

Every kid in every state has equal access to brands. Since it’s not pay for performance it’s not going to stand any legal challenge
 
The issue so far from what I am hearing is the big corporate brand deals are few and far between. Which honestly is not surprising. Hell most pro athletes struggle to get local sponsorship deals. What’s also happening is that most of the elite kids have signed up for representation (agents) and that in itself will put to rest any litigation.

Strongly disagree. There is zero merit and basis to sue. Especially states with legislation. And unless they are losing out on 6 figures which is unlikely it’s a waste of time
 
It doesn't matter what we think. It doesn't matter what we think the merit is. Anyone can bring a lawsuit. That's the point. An attorney might well do it just for the publicity of doing it. Even if the Judge dismisses it, there was still a lawsuit in conjunction with the issue.
